Bail vs. Bail Bond: What Is the Difference?

People often use “bail” and “bail bond” to mean the same thing, but they’re actually different parts of the same process.

What Is Bail?

Bail is the amount of money a judge sets to allow a defendant to be released from jail while awaiting trial. It acts as a guarantee that the defendant will return for court dates.

What Is a Bail Bond?

A bail bond is how most people actually pay bail. Instead of paying the full bail amount yourself, you pay a bail bondsman a percentage as a fee. The bondsman then posts a bond with the court for the full bail amount on your behalf.

Simple Example

If bail is set at $10,000, you’d need the full $10,000 to pay it directly (a cash bond). With a bail bond, you’d typically pay the bondsman a much smaller fee instead, and they guarantee the rest.

Which Do Most People Use?

Most families use a bail bond because few people have thousands of dollars available immediately. A licensed bondsman can get the process moving fast.
